A couple of other things. Quite often a lender will not approve a loan on a home with a failed septic system, but I think you said they had been approved. Or were they approved contingent on inspections?

Also, If you fail to disclose a failed septic system that you were aware of when selling a home, you can be sued and held liable for damages. Out here I've heard of some outrageous outcomes from lawsuits that came from things that were not put on the disclosure form by the seller.

If the seller fails to disclose a failed septic system they can be putting the health of people, wildlife, and the local water supply at risk. As I said, the court will eat them alive.
